Look.. I wanted to report on the new light rail line on the Eastside. It looks great. Can’t wait for it to be properly connected. But instead, the Seattle City Council are being fuckos.

I mentioned the Sara Nelson sponsored bill to repeal the gig workers protections in the last open thread. But The Stranger had one detail that stood out to me. “Her law undermines enforcement by eliminating penalties on companies who fail to pay workers, denying them the right to sue companies for breaking the law and cutting provisions that protect workers against retaliation.”

Wage theft is a huge problem. A quick Google didn’t turn up much recent info, but this post from 2018 has information from the Economic Policy Institute that has it as by far the largest form of theft. And the City Council, specifically Councilmember Nelson, ran on being tough on crime. Yet here they are making it easier to get away with it.

Tough on crime, my ass.

    In December 2023, The New York Times published “Screams Without Words: How Hamas Weaponized Sexual Violence on Oct. 7.” The paper relied on Jeffrey Gettleman for the bulk of reporting on the story. Gettleman’s story relied heavily on Sources within the Israeli government who were not witnesses to any of the alleged activity. Gettleman hired Anat Schwartz a filmmaker and television producer to conduct the bulk of the investigation in Israel

    The most relevant account in the story was Gal Abdush whose body was described as found with her legs spread. Also her body was burned so actual evidence of rape would be hard to pin down during autopsy. Abdush’s relatives including her sisters have reported that no official from IDF or local Police informed them she had been raped. Her mother states that the first she heard her daughter may have been raped was a New York Times reporter asking her how she felt about it.

    Schwartz, it is now revealed to have liked and forwarded Zionist social media posts even before October 7th calling for the absorbtion of all of Gaza into Isreal. Post October 7th has reposted calls to kill all Arabs in Gaza and take the land.

    It is now revealed that Schwartz did conduct interviews with eyewitnesses to the attack on October 7th but those eyewitnesses did not support claims of more than a few cases of sexual assault. Medical Staff at Israeli Hospitals and Rape Crisis centers have now come forward with reports that Schwartz accused them of a “conspiracy of silence” and covering up the mass rapes. Why Israeli medical facilities would decide to downplay such an event are unexplained.

    What did Schwartz do with her failure to find direct evidence? Well she wrote up a story based on unnamed sources within the IDF attesting that these events happened.

    60 Heads and Professors of American Journalism schools have now called on the New York Times to retract the article.

    But it doesn’t matter at this point. Hundreds of thousands of DumbFucks will forever type the tale of the mass rapes on October 7th much as they type the mass beheading of infants carried out on that day.

    And this is on news that China is allowing self driving mode. Irrational exuberance is the words of the day. China is manufacturing lots of E-Cars with price points below Tesla. Tesla Model Y (the cheapest) has dropped to #3 in sales and is the only Tesla in the top 20 Chinese sales. Self driving mode isn’t going to drive sales the way today’s buy-in imagines.

    And drivers assist killed a pedestrian just last week here in the USA. It’s linked to 29 deaths here in the U.S. which is a class-action. Add in the 600 non fatal crashes and that class gets pretty big.

    The cited difference is entirely irrelevant to either the statutes or precedent argued by petitioner. Trump argues that as a former President he enjoys full immunity until and unless he has first been impeached and removed from office. As petitioner Trump argues that anything he does at any time enjoys absolute immunity in order to preserve the independent action of his office. Trump as petitioner argues that the only recognized mechanism where by that immunity may be extinguished is when Congress fulfills the Constitutional process of removing that immunity through impeachment and conviction. Trump’s argument sweeps in all conduct, making no distinction between “official” and “purely private” conduct.

    As in Clinton, petitioner’s challenge is also jurisdictional, arguing that until Congress has intervened to extinguish immunity the judicial branch may not enforce proceedings upon the petitioner at any point including such point as may come many years after the petitioner has been removed from office by the voters, because the threat anticipated by such enforcement would remove the independence of the Presidency.

    Yet in Clinton this very court held that the mere exercise of their core Article III jurisdiction to decide cases and controversies, and, whatever the outcome, contained “no possibility that the decision here will curtail the scope of the Executive Branch’s official powers.”

    Knowing and confident that a criminal conspiracy to recruit imposter state electors to forge fraudulent electoral certificates and then attempt to unlawfully substitute those forgeries in order to defraud the government is not, by the nature of the acts themselves, within the confines of “official acts” of the office of President of the United States, petitioner makes no such claim.

    And so it is abundantly clear that Trump’s claim to immunity being considered by the court is not dependent upon the nature of the acts, which nature includes the time in which they occurred relative to his office. The claim is instead to the nature of the immunity itself.

    But as this court held in Clinton “the Judiciary may severely burden the Executive Branch by reviewing the legality of the President’s official conduct…
    and may direct appropriate process to the President himself…
    It must follow that the federal courts have power to determine the legality of the President’s unofficial conduct.”

    There’s nothing of a unique nature about petitioner Trump’s unlawful scheme to defraud the United States with forged state documents prepared by imposters that would prevent the application of that exact same holding from Clinton, and rejection of petitioner’s claims to a heretofore unprecedented kind of absolute immunity.

    Indeed I do, although TBH I don’t recall “predicting” a climb to $400. Good thing I sold covered calls with a $400 strike price back when the shares were knocking at the door of three Benjamins, and sold them again at a $300 strike price when the shares were back down to the $250 range – both positions still held. I also sold naked puts but bought back some of that this morning to take some profit and reduce some risk, with the spike in share price.

    There’s (1) the share price of TSLA and there’s (2) the TSLA option chain. The real money’s in the options because the shares are so volatile. The shares can go sideways for years and yet one can still make a killing with naked option sales.

    My point is that I don’t really care about the TSLA share value. I just want to profit by naked put sales when the shares are down, and lock in some profit by covered call sales when shares are up. There is so much government money supporting the continued purchases of EVs that TSLA faces zero existential threat risk – creates a floor for the share price, which we saw a year ago is around $100/share. There is so much political warfare around Tesla’s non-union status and Elon Musk’s ownership of Twitter that share volatility will remain very high, and options trading will remain very profitable for those with the stomach to roll with the punches.

    If someone offers you several hundred to one thousand dollars in exchange for your willingness to purchase TSLA shares for, say, $140 between now and, say, a year from now, you probably should take it. In fact, right now June 2025 $140 puts are trading at $1470/100 sh contract. You don’t lose money until the share price drops below $125.30. It’s free money. You should take it.

    Tesla’s future is quite bright in a second Trump term, after all.

    The 47-minute video was produced by the IDF Spokesperson’s Unit from footage retrieved partly from the body cameras of Hamas militants who carried out the October 7 attacks on Israel .[6][20] The video shows images of the attack, including scenes of murder, and mutilation of the bodies of Israeli civilians and some foreign workers. The footage contains graphic content such as burned bodies, including a burnt baby, civilians shot in homes, cars and public spaces, the beheading of a body, bodies thrown in dumpsters, soldiers killed at military bases, and female hostages being pulled by the hair while being kidnapped.[5] Other footage was taken on mobile phones by civilians as they tried to escape, and by first responders after the attack.[5]

In footage taken by civilians, the attackers are seen suddenly emerging at a music festival, sending panicked revelers fleeing across fields amidst cries and moans of the injured. At one military base, militants killed desk staff before seizing their assault rifles.[5]

    In one segment, security camera footage shows Hamas militants killing a man using a grenade. Following this act, the militants are seen retrieving beverages from a refrigerator while the man’s children are screaming and crying.[21]

    It’s an exceedingly important distinction here, because the petitioner’s argument in part has been based on Fitzgerald v Nixon, which is the foundational case that grants “absolute” immunity for “official” acts. That’s why the court took such pains in Clinton v Jones to distinguish between the nature of the acts in question and not the identity of the actor.

    Given the subsequent precedent of Clinton v Jones, the application and availability of the “absolute” immunity described in Fitzgerald would be significantly limited. And it was clearly the court’s intention in Clinton to create that limitation and place it where it did, distinguishing not between any findings of identity of the individual seeking immunity protection, but findings regarding the essential nature of the acts being immunized.

    In Fitzgerald the hearing examiner held that his dismissal violated civil service statutes. But the hearing examiner denied claims of retaliation. Fitzgerald filed seeking damages based on retaliation denied in the administrative hearing and outlawed by statute. The district court dismissed citing SOL. Fitzgerald appealed. The Circuit found that predicate acts of Alexander Butterfield in the Nixon White House served the purpose of concealing the illegal dismissal from Fitzgerald and that this had the effect of “tolling” the SOL. The case went back to the district on remand. Upon subsequent civil disco Fitzgerald was able to file an ammended complaint naming Nixon (and Butterfield). The court denied a motion for summary and moved the case to trial. The defendant moved to the district for dismissal on grounds of immunity and was denied. Then defendant moved to the Circuit on grounds of immunity and was denied. In rulings from both the district and subsequently the circuit it was held that the President of the United States was not entitled to absolute immunity for violating statutes.

    The Supreme Court subsequently reversed and created the grant of “absolute” immunity, doing so for the very first time, and preventing Fitzgerald from ever going to trial. The court declared that it was the President’s unique role that created the need for this immunity. But also that it was the nature of the immunized acts themselves that would determine when immunity applied and when it did not.

    However, the court was unclear, and essentially silent with respect to any question about whether or not a President’s unique “role” was alone sufficient to invoke a shield of immunity.

    President Bill Clinton sought precisely such a shield when he moved for dismissal of Jones v. Clinton on grounds of “absolute” immunity. Ultimately, as we know, the court concluded that it was not the “role” of President that brought the begged for immunity into existence, but rather the nature of the acts being immunized. Clinton as a sitting President was not immunized and was compelled by the jurisdiction of federal and state courts to undergo civil suit for damages while he was still serving as President of the United States.

    Taken in total, only by significantly reversing these precedent cases can this court now grant that shield of immunity to former President Donald Trump for acts that he has never argued in court fell inside the “outer perimeter” of the duties of his office.

    It’s more than convenient that when Democrat Clinton was being sued for civil damages while serving a President of the United States this court was entirely unconcerned about how such a suit for damages in state court and the consequent prospect of thousands of such suits for damages for anything under the sun, might “burden” the “unique role” of President. While Republican Nixon could never be sued for anything that might be “within the outer perimeter” of official acts.

    Having between these two cases created a unique, but defining set of conditions for deciding when immunity applies, this court now finds itself keenly interested in modifying those conditions to the apparent benefit of another Republican (former) President.

    It’s nakedly partisan bullshit. I can only hope they don’t go through with it. But if they do, then Democrats will simply gain more ammunition justifying expanding the court.

    A supercharger network for vehicles that are not Teslas is less necessary if there aren’t going to be vehicles that are not Teslas. Musk’s company is responding accordingly, and there should be no surprise in that.

    The facts, a man told his family he planned to commit suicide. Police arrived to find subject sitting at the table with a handgun. Verbally the subject told police he would put the gun away if they left. Instead they stormed the house shooting and killing the subject.

    Background, two calls to 911 described Heeter as suicidal and in need of ‘talking down’. In one the caller clearly stated ‘do not shoot him!’ The officers who arrived were made aware by dispatch and specifically told Hester had not threatened anyone but himself.

    Officer Bowers approached the house M-16 ready while the other officers approached without unholstering. They had a conversation with a resident who relayed the offer to ‘put up’ the weapon of Police leave. Officer bowers response, “We can’t take that chance. We’re going home tonight.” Note the syntax. This follows the us v them kill or be killed training US Police receive at present.

    After entering the house the senior officer on scene states that he saw Hester place the gun on the table. He then moved ‘slightly to the left’ (Sgt’s Testinony) at which point Officer Bowers shot Heeter the only officer to feel firing was necessary and the only
    Officer to discharge a weapon. Bowers stood and did not administer first aid while other officers called paramedics.

    Bowers in his motion to dismiss sue to qualified immunity cites Hester’s ‘tone of voice’ as threatening to the point requiring deadly force.

    Given the testimony of the lead officer that Heeter was unarmed at the time of the shooting the court finds that Heeter can stand trial as there is sufficient evidence for a charge of unlawful death.

    Further the court found that charges can move forward as the officer violated Heeter’s 14th Rights after depriving him of life without proper trail.

    TLDR version, trigger happy poorly trained cop who went looking to shoot someone did and for a massive judgement personally and against the department.

    Marijuana was made illegal during the Roosevelt Administration in 1937.
