The Domestic Policy Council of which Munoz was Director (DHS Sec. Johnson oversaw immigration enforcement) worked through an array of policy alternatives to present to the White House during the surge of unaccompanied minors that peaked in 2014. Under a court settlement from the previous century DHS continued to limit detention of both accompanied and unaccompanied minors to 20 days. Unaccompanied minors were released to foster families after that.
The Domestic Policy Council never officially considered “zero tolerance”, although Director Munoz has said the idea was briefly considered among a small number of options all considered “grotesque” and “beyond the pale of any civilized nation”.
The idea of criminalizing all border crossings and building a system of baby prisons in which to warehouse thousands of children while their parents were being deported without them as a “deterrent” was never even among the policy options discussed.
But that is in fact the policy that Trump/GOP support even to this day.
It’s time for Trolls4Trump to face some realities. As a party, as a movement, and as a “collective ideology” you’ve all moved so far beyond the bounds of rational, decent human regard that these kinds of idiotic lies, however powerful they may be among your tribe, have no impact or meaning elsewhere. I think immigration policy, and in particular “zero tolerance” provides a very useful example of how American conservatism has transformed itself in the last decade or so.
Setting aside all the rank hypocrisy and general lying, there are some policy inflection points where modern American conservatives sincerely believe they are pursuing a rational and ethical agenda. Immigration is one example. Starting from the assertion that “presence” within the US without either citizenship or authorizing documents constitutes a criminal violation, the GOP “zero tolerance” policy concludes that all such persons are criminal offenders and shall be prosecuted.
They support this conclusion by arguing that if the laws that “secure” the borders and the legal framework that defines our sovereign borders are not held entirely, 100% intact at all times and in all instances then sovereign borders become relatively meaningless. From this they then argue that the very idea of a sovereign nation becomes meaningless. And then eventually conclude that without a “zero tolerance” policy we cease to be The United States of America and risk losing all of whatever rights, privileges, and benefits that entails. Our nationhood itself, they claim, is at stake when it comes to “zero tolerance”.
It’s a fairly direct, and simplistic argument. But it is at least based on reason. The conclusions they draw may be incorrect and argued against. The starting premises may be tremendously flawed. But the method of reasoning itself is not unsound. But is it in fact ethical?
It’s hard to say at times, especially from a modern conservative’s point of view, since they seem to ignore a lot of the ethical considerations. But if pressed they often declare that whatever ethical problems might entail from “zero tolerance” are swept aside by the danger of “open borders”. At this point the argument, and the reasoning behind it, becomes very bad faith. Obviously positioning “open borders” against “zero tolerance” is a rationally flawed and bad faith argument. Whether presented as false dichotomy or slippery slope, it just isn’t true at all.
But beyond the collapse of reasoning, the ethical paradigm described rests on that same flawed reasoning. The Obama administration approach to the surge of refugees and unaccompanied minors at the southern border did not imperil United States national sovereignty or even threaten it. The math alone simply denies this. Always has. To whatever extent our national “destiny” or “self-direction” is influenced or interfered with by non-citizens, it is clearly far more influenced by other sources, like foreign investment, foreign debt finance, foreign lobbying, and foreign spending on dark money campaign PACs.
Ignoring the fundamentally unethical consequences of “zero tolerance” is not justified by “open borders” nor would it be if that were even a real thing. Modern conservatives delight in “reluctantly” implementing family separation and baby prisons is driven by something else. The grotesque cruelty the policy implemented clearly weighs upon some conservatives. So they struggle to justify it with fabrications of both-siderism and reiterations of defenses of “national sovereignty”.
But I think it’s more about a culture that has come to feel so threatened that conservatives have managed to deny the humanity of the people, including infants and small children, being tortured by the policy they support. Something is sufficiently threatening to them that they feel they can justify this cruelty. And that’s why we consistently see the close nexus between this demand for “tougher” immigration enforcement and the rise and embrace of ultra right wing nativist, nationalist and white nationalist groups.
It’s crucial for Democrats to keep this in mind when debating issues like these with modern conservatives. They sincerely see their position as being the more ethical one. And they sincerely see the liberal position as being unethical. How they get there is key to unraveling their arguments in favor of cruelty and torture. Even when we successfully sweep aside fake claims of both-siderism, as seen above with troll S. Cohen at 34, it’s certain that this troll’s sense of ethical superiority remains intact.
S. Cohen is entirely incorrect, however, if he/she assumes (without any evidence) that a few thousand asylum seekers threaten our national sovereignty. It’s been a phony claim from the get-go. These people present themselves yearning to assimilate and become part of that national sovereignty. Their only agenda is to change themselves, not the United States. Compare that to the average Proud Boy member, devoted to a retrograde transformation of American culture, who rejects basic constitutional principles in favor of authoritarianism and who opposes free elections in favor of a reverence of fascists. Where’d they get such an idea?

How the real world works:
Richmond was first elected to Congress during the Obama administration representing most of New Orleans. It’s a safe seat. He’s served well. And he’s risen through the ranks to serve as Chair of the CBC. He has served on Homeland and Judiciary. Since Sept he’s co-chaired the transition. He’s now named Director of the Office of Public Liason.
OPL is an outreach position focusing on domestic policy. It’s one of the premier stepping stone positions in that it is one of a very small handful of senior White House appointees empowered to grant direct access to The President. Directors often go on to serve as cabinet secretaries or run for higher office.
Is it a gift to the energy industry? Depends. Energy companies and their lobbyists who have cultivated Richmond in the past will have a leg up in accessing the new White House. But Richmond still has to take his orders from the President and the President’s COS. And in this case we have a President elect who has outlined a very aggressive goal of transitioning to carbon neutral energy in fifteen years. So Richmond’s role may be in selling that to those industries. Being in a uniquely powerful position unrelated to energy policy with access to the President is a good way of doing that.
And if Richmond performs well and proves himself, he’ll be well positioned to run for Senate in a few years. This is what the long game looks like.
