Powell’s single greatest problem with her appeal of the order, aside from her fundamentally shitty arguments working in combination with her complete lack of rigor, is how thorough Judge Parker was with her order.
It’s 110 pages long. Which can sometimes suggest a judge with an axe to grind. But there’s really no fluff and the judge doesn’t go out of her way to criticize or mock. Federal judges are not often known for their patience with shitty lawyering in their courts. Even less so with dishonest lawyering. But what stood out to most people who read it last summer when it was published was just how agonizingly patient Judge Parker was in walking back over such painful ground to carefully and thoroughly describe all the misconduct.
If the 6th ever hears the appeal (which may truly be in some real doubt here) they are going to direct their attention to that order. And what it describes is flagrant legal misconduct carefully and thoroughly cataloged by a district court judge forced to endure it by appellants. Probably every single one of those circuit justices has been in Parker’s shoes at some point. Many more than once.
This will not go well for Powell and the rest of team KRAKEN.
