And that the right collection of cultural grievances presented in the right way could overcome their cynicism and discouragement enough to get meaningful numbers of them to vote for a change. They’ve been humiliated and degraded by their own poor performance and the corruption and perfidy of those they admire. Trump sues to get a Special Master appointed to review classified documents recovered from the basement of his private sex club.
In his lawsuit Trump argues that the classified documents might belong to him and that the DOJ can’t be trusted to determine what is or is not “classified”.
Trump asks the court to appoint a Special Master to review classified documents and advise the court if any of them were previously declassified by Trump.
Judge agrees with Trump and appoints Special Master.
Judge orders Special Master to start with a review of the documents that have been marked as “classified”.
Judge orders Special Master to determine if any of the marked documents have been “declassified” by the FPOTUS.
Ahead of today’s conference Special Master asks Trump to indicate which if any marked documents he ever “declassified”.
Trump responds “Nope”. Tells the Special Master he demanded to be appointed that he won’t say if he ever “declassified” any of the marked documents.
Trump tells Special Master that he might need to keep that “declassification” a secret in case he needs to use it defending a criminal indictment later.
In a lawsuit like this one seeking equitable relief, the plaintiff tells the court precisely what relief they are seeking. In Trump’s case, and with respect to the recovered documents bearing classification markings, the appointment of the Special Master to review those documents and make a conclusion about whether or not Trump had declassified them was the relief sought.
Now Trump refuses to participate in obtaining the relief his lawsuit sought. Trump’s lawyers will drag Cannon back into this. And I assume she’ll find a way to rule in his favor. Doing so will, however, simply remove from her original order the exact form of relief the plaintiff sought and perhaps substitute some other form of equitable relief not contemplated in the original lawsuit. This will bring further discredit upon her conduct in hearing and deciding on the lawsuit. And whatever additional relief she orders would naturally be stayed upon request.
It’s been less than a week and it’s already off the rails. Trump’s lawyers are scared to death that he’s facing a criminal indictment. And they are openly docketing letters pleading for it all to go away.

His lawyers can be expected to have anticipated this question. Although it’s noteworthy that they fail to address it in their docketed letter to the SM.
I will not be surprised if their response is a demand for more delay as they “consider” the request. And the SM will probably give them the time they ask for. But I can’t help but point out how the way this process is unfolding so far has essentially substituted the judgment and timing of Trump’s lawyers for that of the courts and the SM. I assure you regular people don’t get this treatment. Ever.

When an individual is indicted for a crime their right to due process affords them an opportunity to challenge evidence that might be introduced by the government to persuade a court of their guilt. Judge Dearie just had to remind the Trump Klown Kar that they are in a hearing over a civil matter, not a criminal matter. And that the cause of the civil matter being litigated was the lawsuit they filed. Wow.
Next Dearie points out to the Trump Klown Kar that as the plaintiff in the civil dispute they bear the burden of proof with respect to their claims of privilege over the documents bearing classification markings. He points out to them that he already as prima facie evidence that the documents bearing classification markings are in fact classified documents because they bear those fucking markings. And then he once again politely reminds the Trump Klown Kar that it is for them to provide some evidence to him that those documents have been declassified.
They refused.
Klown Kar: ‘We should not be in a position to have to disclose declarations, witness statements.’
Dearie: ‘My view us you can’t have your cake and eat it too.’
This proceeding has not gone well for the Klown Kar. Dearie has questioned the entire premise of reviewing the classified documents asking at one point: “What business is it of the court?” When the Klown Kar begs the court to begin discussions of the process for obtaining clearance to view the classified documents Dearie responds that he will not be considering the obtaining of clearance, either for the Klown Kar or for himself until and unless it is determined that clearance is needed. Again “What business is it of the court”. Followed by “It’s a matter of need to know. If you need to know… you will.” Dearie goes on to inform the Klown Kar that he hopes to resolve questions about the classified documents without reading them himself. Which then fairly obviously implies that the Klown Kar won’t get to read them either. And if Dearie will not be reading and reviewing those documents for claims of privilege at all, but only considering their classification status, and making that consideration in the absence of any evidence to the contrary presented by the moving party, he should be settling that question to the court very quickly.
Unless Cannon intervenes (and in so doing repudiates her own order) Klown Kar does not get to dig through the classified documents to figure out what laws their client broke, nor do they get any kind of useful delay. Completion of the full review before the midterms seems certain.

It may not be relevant here, but I keep noticing people responding to the perception of a potential threat with deadly force as if fear, no matter how unfounded, automatically justifies killing someone.
Moreover, there also seems to be a chorus of voices misrepresenting self defense law specifically to assert that once someone does something that could justify the use of force, any use of force becomes automatically justified, even if the threat is no longer present.
The result seems to be that people have convinced themselves they’re allowed to kill people who have frightened them or may frighten them, not in defense so much as for punishment.
Whether he’s telling the truth about feeling threatened, or just recognizes that that’s the “acceptable” justification for killing someone, he seems to be operating under this kind of assumption.
Is it because we’ve had it drilled into our heads by police union PR teams and supporting media when police kill someone the only justification they need is a ‘fear for their lives’?
