Trump’s argument is that “since ‘persons’ is not defined, he has the ‘authority to exclude from the apportionment base aliens who are not in a lawful immigration status.'” But to do that, he has to convince the courts that illegals aren’t “persons.”
His substantive argument is this upholds “the principles of a representative democracy,” but that seems awfully weak given that the right to be represented is separate and distinct from the right to vote. Since children, inmates, and non-voting ex-felons are counted for representation purposes, and even slaves were counted (in a fashion) back in slavery days, what’s the substantive argument for not counting other non-voting residents?
Including illegals in the census doesn’t give them any rights they don’t already have (and they clearly have legal rights in this country); it simply recognizes the reality of their presence. Communities provide services to them, which cost money, and the census is used allocating federal and local funds, so counting them is both practical and common sense.

I’m not entirely sure I agree.
In the modern surveillance state for reasons that surpass understanding we have empowered government information gathering of private citizens on unprecedented levels of intrusiveness. It’s now a routine matter for government authorities to dig through your recycling, invade and tresspass on your curtilage, track your private mobile phone, install tracking devices on your car, make pretextural traffic stops in order to fish for evidence, scan your home with infrared sensors, photograph you and put the image into a database, and even sample your DNA all without a warrant.
I think it’s possible that more than a few government officials could use a dose of their own medicine.
