A lawyer for the Republican National Committee told congressional staff members yesterday that the RNC is missing at least four years’ worth of e-mail from White House senior adviser Karl Rove that is being sought as part of investigations into the Bush administration, according to the chairman of the House Oversight and Government Reform Committee.
[…] In a letter to Attorney General Alberto R. Gonzales, Waxman said the RNC lawyer, Rob Kelner, also raised the possibility that Rove had personally deleted the missing e-mails, all dating back to before 2005.

Then lots of folks can send Karl Rove spam and hate e-mails, and fill his mailbox to overflowing. Keep a record of all the spam you send to Karl Rove, make PDF copies of the e-mails, and e-mail and fax this to all the Democrats of the House and Senate Judiciary Committees.
Then, when they do their subpoenas, they can see whether or not Karl Rove simply deleted this spam. If so, then they can charge him with obstruction of justice.

Could be, but the Hatch Act prohibits various partisan political activity from being conducted on the government dime or the government time. Which is why people like Karl Rove use outside e-mail accounts when they are engaged in partisan political activities, instead of official government business. So there is a conflict between these two laws. People like Rove have at least tried to comply with both sets of laws. Actually, what the law says is that public business done by senior government officials is to be conducted exclusively over the official e-mail system so that copies are kept automatically. Mr. Rove is in violation for using private e-mail accounts for the public business. Still, so long as copies are kept, this would be a minor matter.
Of course, it happens that people with several e-mail accounts may occasionally use the wrong one accidentally. It has already been shown that this has happened several times. As this was always a danger, the RNC actually put procedures in place that would ensure that all of those e-mails were also archived. Apparently Mr. Rove cannot be blamed for the loss of these e-mails, as he cannot delete them himself.
Then, oddly enough, just when those e-mails were about to be subpoenaed, some unknown minor functionary accidentally deletes them. Oops, sorry, they’re all gone now with no trace and no backup copies anywhere, and it couldn’t be Mr. Rove, because he doesn’t have the ability to delete e-mails.
Apparently, unlike anyone else with a server, the RNC does not routinely make backup copies of data.
Please, Mr. Pope. Sometimes things are just indefensible. Too many accidents, combined with too many incompetents acting at prcisely the right time and combined with business practices unlike any other large organization.
Both the RNC and the White House are sounding like Bart Simpson, saying “Nobody saw me do it! You can’t prove I did it!” None of this passes the “sniff” test.

The laws are not in conflict. The Hatch Act basically prohibits use of taxpayer money for political purposes. So, some one else neds to pay for the server infrastructure to support political purposes.
It appears the RNC voluntarily accepted this expense. They then became subject to the Presidental Records Retention laws. If they intentionally or even inadvertently failed their responsiblity under the retention laws, they should be subject to approrpriate penalty and/or sanctions.

Actually not. The 5th amendment prohibits taking private property for public use without just compensation. In this case, Karl Rove used an e-mail system that belonged to a private organization (Republican National Committee) and would have at least claimed to use a computer that didn’t belong to the federal government to send and receive these e-mails. The Presidential Records Act might mandate that these e-mails be preserved (it is a matter of interpretation), but does not impose any duties on private individuals or organizations to do anything. Even if it did impose such duties, the Presidential Records Act contains no provisions to compensate private organizations or individuals for performing these duties. So there would be no enforceable violation of the law if the RNC failed to preserve these e-mails or even decided to actively delete them.
Moreover, federal law would prohibit the Bush administration from compensating the Republican National Committee in any event for preserving these political e-mails. The Hatch Act prevents federal money from being spent for partisan political purposes — which would include a prohibition on compensating the RNC from keeping and maintaining an e-mail server and preserving the e-mails.
Yes, it may look bad now, but I think that Bush administration officials did their best to accommodate the seemingly conflicting demands of the Presidential Records Act and the Hatch Act. I would say the Hatch Act should come first — it is much more important that the White House doesn’t use government resources for partisan political purposes. So if there is any doubt as to whether government e-mail or private e-mail should be used for a given communication, then private e-mail should be used.

On the other hand, a good sysadmin running an email server, keeps logs and back-ups. It isn’t an additional expense, it’s part of the deal.
Really good ones have a published record retention policy. And most delete such logs and back-ups on a regular scheduled basis. (there is only so much dasd in the world :)
The RNC is falling once again into the cover-up hole. Instead of claiming the records were lost, they should have stated the records were deleted on schedule according to established policy.
Does Mr. Rove have multiple computers and Scrupulously segregate Offical WH activity on one and Political activity on another. That’s what I make a best effort to do.
