And remember, from when we’ve discussed this before, Miller is an “and” test. All three prongs of the test must be met in order to justify a government intervention restricting expression. Giving the community standards clause unlimited reach and authority, while stabbing originalism in the neck, would still accomplish nothing if these restrictions fail on the other two prongs of the test (which they always do).
So that leaves Roberts dumping Miller entirely and replacing it with… very likely something that doesn’t work. Because Miller represents a century of incremental progress toward something that could be applied practically. And practicality encompasses work by artists like Dread Scott, Lisa Carver, Robert Mapplethorpe, and Andres Serrano on unrestricted public display in museums and art galleries, and works like Trainspotting, Fight Club, Delta of Venus, and Catch 22 on unrestricted shelves in public libraries.

A racist like you probably liked that all-white white funk bands got gigs and black funk bands didn’t.
I knew both sides, and was in the middle, playing in Seattle’s first mixed-race funk band, which was the house band at a CD dive called the African Hut.
Push was the all-white band that got most of the funk gigs. Good guys, all of them, especially Big Joe Erickson, who started the band. I went to high school with those guys.
Big Joe went on to be a songwriter for notable black vocalists, then died way too young.
