Now, the twist.
DOJ’s motion for a partial stay of that order would leave in place the injunction over NARA until such time as the full 11th can hear any challenge as to jurisdictional errors. The DOJ’s notice of appeal constrains the district judge from moving forward with the Special Master hearing. But it isn’t clear that she is experienced enough to understand this. So if she denies the limited stay and moves ahead with her hearing on the Special Master then DOJ can move for immediate relief before a panel of the 11th.
Assuming Trump is innocent with respect to the espionage act violations and obstruction, then his primary legal interests lie in keeping the injunction against NARA in place, since it has been Trump’s position that he does not trust his “privileged” papers and materials in the hands of NARA. I don’t have a clue what it is he claims he’s protecting. And I’m not willing to speculate. But if Cannon really is trying to loyally serve Daddy Twump she finds herself in a box of sorts. If she grants the motion for limited stay, DOJ gets to move ahead with a criminal investigation that makes Trump look like a fucking clown completely unfit for office (and for making judicial appointments, for example). If she denies the stay and moves ahead with the Special Master hearing and further process then her order along with that protective process stands to be incinerated by a panel stay from the 11th.

Seeing the rights and the humanity in another person, particularly another person you don’t know or a person who is very different from yourself, is like a form of empathy. In most cases it isn’t something a person is born with. It has to be taught.

Here’s another thing worth noting about DOJ’s motion for limited stay in SDFL/Cannon. In DOJ’s original filing for the stay they informed the court that they had already notified opposing counsel representing Trump about their proposal to carve out the classified docs. And that Trump’s lawyers indicated their intention to oppose even that. So Cannon’s minute order last night directing Trump’s lawyers to “consider” DOJ’s proposal before the hearing today is probably an indication that she sees the box she is now in, and is encouraging Trump’s lawyers to see it as well.
It isn’t evidence. And you can’t argue it in court. But I think this makes it very clear that Trump has his finger prints on the espionage and obstruction.
Leaving the rest of the order in place, requiring the Special Master to review all the non-classified stuff and potentially removing it from discovery by the House Committee was the point of stealing all the documents in the first place. It’s important as hell to Trump. Important enough that he and/or his attorneys stole it, hid it in a damp basement, and lied to the government for eighteen months in order to keep them away from it. Then when they ran out of moves and were caught off guard by the warrant they may have even risked very serious criminal charges to delay and further obstruct. When all they ever really needed to do was comb through it carefully and remove all the shit marked classified, while retaining all the Jan 6th insurrection planning documents.
Now when DOJ offers them yet another lifeline, to leave the “Hang Pence” documents out and only continue with the classified stuff, Trump turns it down? Seems to me the only reason you do that is your guilty as fuck for mishandling the classified stuff too.

This evening I walked the city with my 1st cousin’s daughter. She’s visiting NYC, and staying with me for the last couple of nights until tomorrow. She’s been in the US for the last three weeks. At first she stayed a week in Boston at some type of school program studying English. Her English is pretty good. She’s studying to be a dentist in Spain. She was born and grew up in Italy. After a week in Boston she flew to Miami to check it out, and from Miami she flew to NYC. She is approximately 22 years old. She knows Italian, Spanish and English fluently.
