There are going to be a few unique and interesting consequences arising from this. Congress could of course change that. But they won’t. I expect that some special accommodations will have to be made by the BOP and Homeland Security to address it. It would not be unexpected that Jack Smith would already have assigned counsel within his staff to research the issue and prepare recommendations. That might include some preliminary outreach to BOP and Homeland for input and commentary. Sentencing judge will understandably want to receive extensive briefing on the matter prior to sentencing. But once again, because LOCK ‘EM UP “conservatives” wrote strict binding statutes regarding federal sentencing, when unemployed, private citizen Trump is convicted he won’t be getting any special treatment as far as the time calculation is concerned. I don’t honestly know enough about it to say if it would be legally impossible for him to be sentenced to some kind of “home” confinement. But what I do know is that in general, that kind of alternative confinement is limited in the federal system, again by statute, to inmates within 12 to 18 months of their scheduled date of release. The CARES Act granted authority to the BOP to extend that time frame during the COVID Emergency. But that official emergency authorization has now ended.
I expect the result will be something weird and unfamiliar, like everything else about “Modern Republicans”. I could well imagine the BOP converting some kind of semi-detached, securable housing arrangement within the enclosed premise of an existing facility for this specific purpose. That way SS agents would not have to be housed in the immediate company of other convicted felons. On duty as part of his protective detail, they are always armed. That would not work in Gen Pop. And it would not be safe for anyone.

We could make the system a lot more fair, and progressive even without changing any brackets or rates.
And we should not treat the tax system in isolation. A whole lot of federal programs function like a tax, even if they are not included in annual/quarterly filings. And likewise many programs also function as de facto credits.
Why is there a sugar program in the farm bill?

In order for us to understand the criminal indictment that Trump and his co-conspirators are about to face we must inevitably confront the Electoral Count Act of 1887.
Following the disputed election of 1876 Congress sought to limit its involvement in any similarly disputed future election by clarifying and adding onto the Electoral College procedures laid out very basically in the Constitution. It was intended to establish clearly what the Constitution had left somewhat vague, so as to hopefully eliminate questions about who the duly certified electors would be, provided that the state followed the prescriptive procedures. And while it provided that each chamber of the joint session could individually object to the inclusion of a state certified count, it made absolutely clear that it was the role of that state’s Governor to break such a tie, or resolve such a dispute with their certification of their list of electors.
That’s important. Because it may form a part of the underlying crime that the conspirators of J6 were attempting. Their stated theory was that by offering prolonged procedural delays to the count. by introducing fraudulent “alternate slates of electors” not having ever been certified by that state’s Governor, and ultimately by launching a violent mob attack on the joint session, the Vice President could introduce from the podium a “dispute” from a given state and could “rule” that the session would be suspended until that state had made a final decision, independent of the previously certified count.
That last bit is against the law. And it was against the law on January 6th of 2021. The law that it would clearly violate was the Electoral Count Act of 1887, which a) gives no such power or authority to the Vice President but rather specifically limits it, and b) already clearly determines how any such dispute arising from any “alternate” slates is to be resolved by statute – the previous certification prevails. Always. And so it is that law that the Trump campaign, and the various J6 plotters conspired to violate, as well as quite a few others.
But I think we have to assume that Republicans are going to pretend that the Electoral Count Act of 1887 says other things, or doesn’t say certain things that it does, or leaves room for them to form plots to overturn democratic elections that disappoint them.
So I just want to emphasize a couple of key points. First, there is just absolutely no question but that the Act assigns legal primacy to the state certification of the electoral count. Whatever the fuck the official state certificate signed by that state’s Governor says, provided that it is certified no less than six days before the meeting of the electors, then that is the final word. Those are the electors. That is the count. SCOTUS confirmed in Bush v. Gore.
And second, in absolutely no way whatsoever does the Act grant any power or authority to the Vice President other than to open envelopes and bang the gavel.
