I wholeheartedly agree with both of your analyses that the decis is pretext and directly aimed not only at expansion to many other rights and many other precedents, but very clearly (Alito says so) at Griswold, and Obergfell, but also obviously Loving v Virginia. We should be very clear whenever any discussion about this decision is afoot, that the intent of it and the four decade project to tilt the court is to roll back all the major civil rights of the last 100 years.
However I also hasten to point out that Alito’s reasoning in Dobbs is based on something the court made up entirely on its own. There is no “textual” basis for “deeply rooted”. It is not in the Constitution, nor in any letters among Framers, no even in any original legislation. It arises from substantive due process analysis which itself is a complete fabrication of the court – who I would remind you nobody ever voted for. And it’s origins are actually pretty shameful.
Substantive due process in short is the court’s idea that an individual’s “due process” rights extend beyond mere procedure, i.e. right to timely notice, right to trial, right to civil redress, etc. Substantive due process was first created by the court in Dredd Scott as a way of bringing into the law unenumerated protections for individuals from the will of the elected majority. Essentially Taney holds that white men have an unenumerated right to own slaves. And he goes on to hold that, because of that right, Congress would be exceeding its constitutional authority if it were to ban slavery in the U.S. western territories.
Now, of course, it’s vastly modified since then, not least by the due process clause of the 14th amendment. And in its current form we get substantive due process from a famous precedent establishing case from the 1930s United States v Carolene Products that is said to have ended a very long period of history in which the court routinely overturned most regulations of business – commonly referred to as the Lochner era for the original case overturning a New York bakery regulation. Carolene codified substantive due process, established the methods and required rigor for analysis, and specifically set out unenumerated rights for protections under its holding.
The key point, however, is to recognize that they made it all up. As I’ve pointed out to the superstitious troll, the original bill of rights clearly declares that there exists an infinity of unenumerated rights, secured to the people, protected by their constitution in the 9th amendment, no stupid fucking “substantive due process” needed.
Moreover, even if “substantive due process” was a real thing. it is in fact very, very, very clear that rights like “privacy” and “bodily autonomy” are far more deeply rooted in history and tradition that “the right to contract” or “personhood” as declared in Peoples United.
Alito isn’t stupid. He knows all this. He knows everything he’s writing in his decision in Dobbs is legal reasoning entirely fabricated by courts (not by lawmakers) over many decades in order to narrow the rights of individuals for the benefit of a privileged minority. That’s entirely the point. And there’s nothing legitimate at all about any of it. Given all that we have to admit that we aren’t ever going to prevail here by means of legal arguments referencing the constitution. Alito’s decision is a declaration rejecting individual rights based in constitutional legal arguments, sound or otherwise.
It’s a simple “fuck you”.
Figuratively, but very nearly literally. He’s saying that with five votes he doesn’t fucking need the constitution. He’s declaring that between them, he and the other four can do whatever they please with your laws, your rights, your freedoms, and your electoral majorities too.
