But in all states part of making a self-defense argument to the jury involves establishing your client’s mental state when they took a human life.
It’s a terrible defense to be talked into. You’re a terrible defense attorney if you attempt to persuade your client that they acted in self-defense if they don’t really believe it. And while many defendants accused of murder will tell their attorneys they were acting in self-defense, it’s a pretty bad one who doesn’t bother to investigate the claim.
This obviously bodes very ill for Mr. Rittenhouse’s defense. His team are shitting themselves today trying to figure out where this came from, why they didn’t know about it, and how to get it excluded or at least to discredit it somehow. But what it really tells me is that he’s being represented by attorneys who just are not looking after him at all. It should not have come to this. It still does not have to. Flipping back and forth from official FBI statements to “unnamed sources” there’s considerable risk of error. “Journalists” do this foolish thing all the time. We should not.
The avowed and frequently stated purpose of the terror attack was to interrupt and prevent an official proceeding. That is a federal crime.
And the proceeding itself was no mere ceremony.
While ceremonial in nature, in legal and Constitutional terms the official recording of the electors votes by the Congress is perhaps the single most important official proceeding that the federal government undertakes.
Some of the most serious criminal charges brought so far have to do with this criminal purpose. A charge of conspiracy under federal law needs only that – an underlying, predicate offense, involving two or more persons, who form an agreement, and commit an overt act in furtherance. A criminal conspirator does not even have to share the same intent to be guilty of conspiracy. In general conviction under 18 U.S.C. § 371 for conspiracy to commit a substantive offense merely requires proof that the accused committed an overt act in furtherance of that conspiracy.
Every single other criminal element required under the statutes is present – two or more persons, agreement, etc. The only thing that either is not being charged or is not in evidence, would be the overt act in furtherance. And for literally dozens of those currently being held pretrial, there’s an abundance of that evidence already on record in the information filed.
There’s a reason why conspiracy charges are being held back at this point. It’s a legal and investigatory reason. It’s the kind of reason that a “unnamed law enforcement official” who doesn’t really know anything about federal criminal conspiracy prosecutions would not understand. It’s because any criminal charge filed must be accompanied by the basic information that supports the charge specifically identifying the statutory elements. In the case of 18 U.S.C. § 371 that means identifying all of the criminal conspirators involved.
Fucking that up can wind up being exculpatory, in several ways. The simplest is that the prosecutors simply got it wrong and “fucked up”, leading to the “plate of pasta” defense. It can really damage a case. But more serious would be a description of the conspiracy and those involved, but somehow identifying the wrong people or getting the relationships wrong. Entering erroneous information like that into the pretrial record opens the door for the entire prosecution to be put on trial.
There are conspiracy charges coming from the Jan 6 terror attack. Of that I have absolutely no doubt. The fact that they are not yet filing information about it tells me that it is ongoing, slow to develop, and fairly complex. Those are really common features of a complex criminal conspiracy investigation and prosecution. And at this point the FBI is still figuring out how to log on to Parler.

You piqued my interest and I finally had time to read the original Reuters report that is being so widely aggregated and aggressively quoted.
It’s got some problems.
First of all it looks very much to have been sourced from House lawmakers/staff. The two reporting it are well known to work those sources, it’s recess, nice quiet time to catch up and share gossip, news is slow, nobody is watching, etc.
It’s wrong on the law in a few ways. First of all by confusing federal conspiracy charges with charges of “sedition” by making reference to something called “seditious conspiracy”. Seditious conspiracy is a criminal statute entirely separate from 18 U.S.C. § 371. But as I hope I made clear, charges of simple conspiracy under 18 U.S.C. § 371 can arise from any underlying criminal violation. These guys want it to be about “sedition”. It does not have to be “sedition”. This is a reboot of “collusion”.
But these idiots really give their game away when they then mention racketeering. Fuck me. RICO this is not. Nor would any marginally competent criminal prosecutor ever want that. RICO is a last resort that is very, very hard to make and practically never applies to shit like this. We know that whoever the fuck it is that was talking to the two Reuters reporters is a politically motivated mattress stain on that basis alone.
