    Here’s the Japanese automakers’ market response to the news of the deal:

    Following the announcement, Japanese automaker shares led the Nikkei share average (.N225) to a one-year high, closing up 3.5% on the day. Toyota Motor Corp’s (7203.T) shares jumped by 14% with Honda Motor Co (7267.T) up more than 11%.

    As you know, voters must affix signatures to their ballots, which are then matched against voter registration records. After the 2024 election, there were ballots with signatures that didn’t quite match, or which voters simply forgot to sign, as there invariably are in large-scale elections.

    There are legitimate reasons why a signature on a ballot might not match the voter’s signature on file with the election department. A common one is an elderly voter’s signature may be shaky due to hand trembling. And some people’s signatures change over time.

    State law provides for “curing” ballots with missing or questionable signatures by having the voter signing a signature card. There’s a window period after the election, about two weeks, to do this. County election offices notify these voters they have to cure their signature for their vote to count.

    The law allows the campaigns to obtain lists of these voters from election offices and then try to contact them, and if they haven’t responded to the notifications, the campaigns or parties can try to contact them, have them sign the card, and then turn it in to the election office.

    After the 2024 election, given the closeness of the election, both campaigns organized signature card drives, although the Republicans got a late start and didn’t have the Democrats’ manpower resources, so they collected fewer cards. The Democrats benefitted from an earlier start and roughly 6,000 volunteers, mostly recruited by labor unions.

    This was over 20 years ago, and I forget the exact numbers now, but the Democrats collected roughly 1,100 signature cards and the Republicans collected around 300 statewide.

    Of those numbers, the Democrats’ signature cards had an approximately 70% validation rate. The validation rate for the Republican cards isn’t known, because the Rossi campaign, on the advice of their lawyers for reasons I’ll explain below, never submitted their signature cards. Had they done so, and enjoyed a similar validation rate, Rossi would have gotten about 210 more votes, enough to win the election.

    But the Republicans’ lawyers had made a tactical legal decision to withhold their signature cards, because they were trying to convince the state Supreme Court to reject the Gregoire campaign’s signature cures, and believed submitting theirs would undercut their arguments to the court.

    It was a gamble they lost. The court ruled in favor of Gregoire on the signature cards, so her cured ballots were counted. Rossi’s curable ballots were not counted because his campaign chose not to submit them to election officials as part of a legal strategy that failed in court.

    This wasn’t cheating by the Democrats. Nor were these what you choose to call “found” ballots. It was a deliberate choice by the Republican side to waive counting votes for their candidate that only needed to be cured by signatures in their possession. It’s somewhat speculative whether they had enough actual cures to win, because they didn’t submit their cards, but I feel comfortable saying Rossi probably would’ve had enough votes to win had they done so.

    My sources for this are my personal knowledge and what the Democratic legal team led by Jenny Durkan told me.

    Although Rossi probably had enough signature cards, that’s not definitive as to who actually won the 2024 election in terms of eligible votes, because he probably received a significant number of votes cast by ineligible felon voters.

    The felon votes were inadvertent, not due to the machinations of a candidate, campaign, or party. State law on felon voting at the time was ambiguous and confusing. Election officials in different counties interpreted it inconsistently, and many of the felon voters were told by their parole officers they were eligible to vote. The legislature subsequently cleaned up the language of the law so this wouldn’t happen again.

    The Republicans built much of their election challenge on these felon votes, but while the number of these votes was roughly known, because there was no way to determine how many of these votes each candidate received, Rossi’s legal team could only present a speculative statistical analysis, which Judge Bridges rejected.

    It is likely that Rossi’s vote total was inflated by ineligible felon votes significantly more than Gregoire’s, based on the fact most of these felon voters were white males, a demographic that tended to favor Rossi. There are two pieces of anecdotal evidence that indicate Rossi won the ineligible felon vote by a wide margin.

    1. Of the four ineligible felon voters who signed affidavits submitted to the court, all four voted for Rossi.

    2. A reporter found 11 ineligible felon voters willing to say who they voted for, 10 men and 1 woman. The woman said she voted for Gregoire. All 10 of the men said they voted for Rossi.

    The 2004 election is complicated by the fact there were misplaced ballots, ineligible felon votes that were counted, and signature cure ballots. Despite intense scrutiny, no evidence of intentional manipulation or ballot box stuffing was ever found. These kinds of errors are normal and happen in all large elections.

    Even though Rossi probably had enough signature cards to overcome Gregoire’s final victory margin, he almost certainly would have lost but for ineligible felon votes in his favor. So, I believe Gregoire really did win that election in actuality, not just officially.

    As a final note about the 2004 election, John Carlson at KVI was a major propagator of the Republican mythologizing of that election, and on Monday, January 31, 2005, Carlson was doing a show about who should pay for a revote* and invited listeners to call in. So I called in. Afterwards, I typed a transcript for my computer files, for reasons that will be obvious.

    When I called in, a male picked up and said, “I want to ask you a question.”

    Me: Okay.

    Male voice: Do you think a woman’s desire goes up when she’s pregnant?

    Me: I wouldn’t know.

    (Laughter in background, including at least one female voice.)

    Me: You’re having a good time there, aren’t you?\

    No answer; I was put on hold. When I reported the incident to KVI management I told them, “I can take a risque joke, but I got the impression they were making fun of the show’s listeners, which might not be a real good thing for the business.” I don’t know what, if anything, they did about it.

    * There’s no provision in Washington law for do-overs of disputed elections.
