We can’t know at this point if an apparently erratic, undisciplined, and shockingly incompetent Fat Hitler 47 administration will succeed in any substantive way in harnassing the immensity of the federal administrative state and directing it to accomplish his signature campaign promise of forcibly deporting every single undocumented person residing currently in the United States.
Nor can we know or predict if even some of the lesser related promises will be acheivable. His choice for “Border Czar” (a position which does not actually exist) Tom Homan suggests to the media that all these promises will be accomplished. But he also explains that it will take time and proceed incrementally, initially targeting as he puts it “all resident aliens legal or not who have committed crimes”. This obviously means that current legal residents who are holders of “Green Cards” (legal permanent residents) as well as holders of EADs and I-94 documents would be subject to deportation orders if they are found by the agency to have committed unspecified crimes. Homan refuses to say what specific types of crimes would trigger such a deportation order. Nor will he say what, if any, process would be afforded to such persons subject to this kind of deportation order. But he does clearly say that this type of enforcement would be among the very first things the new administration would implement well ahead of anything else that would require expanded resources. And as a reference he has very consistently suggested that some administrative offenses including failing to update registration information or failure to carry documents could trigger such an order. So this represents a substantial expansion of current policy wherein deportation orders are normally only triggered by aggravated felonies or crimes of “moral turpitude”.
So it’s probably safe to predict that withing the first 100 days some version of this policy would be put into effect. And as such it would implicate somewhere between 13 million and 20 million residents, workers, students, and others currently living legally in the US. So at the very least it’s worthwhile to think about what effects this new policy would have.
This kind of radical expansion of enforcement would put these residents into a kind of limbo wherein their status and even thier very existence would be constantly at risk from any kind of legal interraction. A workplace dispute, a conflict with a neighbor, a professional rivalry, or a misunderstanding by yet another lazy, ignorant, xenophobic cop would present an almost incalculable risk to such a person. And the opportunity for such people to be victimized and exploited by these conditions would probably explode.
Bear in mind that these are legal residents, many of whom may play important roles in their families, communities and in their places of employment. Some, especially the most qualified and capable, will probably respond by leaving the US, at least eventually. Some are probably already looking into those options. Someone who has made investments and sacrifices to establish a business, a profession, a home, a mortgage, kids in school, and roots in their community would not willingly see all that put at risk of being stripped away over a DUI or a weird-beard neighbor killing their dog. They’ll make plans. Those with fewer resources may choose to stick it out. But if Americans are who we now appear to be, the existence of these legal residents inside the U.S. will increasingly become an unliveable experience for many if not most. And I expect that will develop fairly rapidly.
