The third possibility, that charges would be withdrawn, as they were when former President Trump ordered his DOJ to withdraw criminal charges against his former National Security Adviser for a series of false statements he made to FBI agents in January of 2017 conducting his clearance screening and confirmation screening about conversations he had with Russian Ambasador to the US in December of 2016 that were monitored by the NSA (because they monitor the conversations of the Russian Ambasador for obvious reasons) is almost impossible.
So there will either be a plea or a trial.
Once charges are finally filed (after five years of investigation and cooperation) that triggers certain legal rights and presents legal opportunities to now defendant Hunter Biden that he did not enjoy before. His attorneys may now begin to file various motions to the District Court of Central California to obtain discovery of evidence, to challenge the filing of charges, to challenge any of the evidence in discovery, and to inquire into details about the conduct of this and other grand juries related to these charges. Not only could those motions change the complexion of the case as the public currently understands it, but naturally it may also produce delay as those issues are systematically resolved.
The prosecution case, at least as I understand it, is not terribly complicated. And that fact is amply demonstrated by how much of the indictment was devoted to a narrative description of the defendant’s “lifestyle” and spending, which are unrelated to the charges. But the defense in this case might be very complicated indeed. That’s because of the amount of evidence already in the public record of misconduct on the part of the Special Counsel bringing these charges. Whether, and how much, that misconduct implicated the defendant’s right to due process and equal protection will almost certainly become part of the defense strategy. And the inquiries into that misconduct are very likely to produce prolonged delays, as the Special Counsel and the DOJ (all of whom answer to the defendant’s father) will resist those efforts by the defendant.
There’s good information available to you in all that if you care to pay any attention to it. As President of the United States the defendant’s father has had the legal authority to intervene on behalf of his son since the day of his innauguration. But in that time his only intervention into this case came when he appointed the United States Attorney for Delaware that Donald Trump first appointed, to become a Special Counsel allowing him to operate independently of the DOJ and the various appointed United States Attorneys in each district. So his only intervention thus far has been to empower the prosecution of his son, not to weaken it or obstruct it.
As the indictment moves ahead toward a trial you can also observe to see whether or if the government intervenes to assist in the likely defense as I have described it to you. The record of communications between the former United States Attorney for Delaware (now Special Counsel) lies in the hands of the main Department of Justice overseen by Attorney General Merrick Garland who reports to the defendant’s father, the president. The record of communications and internal deliberations within and among that prosecution team investigating the President’s son, as well as their communications with members of Congress and other outside political entities unrelated to the investigation, could be simply turned over to the defense today with nothing more than a phone call by the Attorney General. You are welcome to observe and see what happens and then attempt to learn from that if you like.

Ethan Crumbley was 15 years old when he killed 4 fellow students and wounded 7 others plus a teacher. Now 17 years old, he was sentenced today to life in prison without parole. He’s expected to die in prison (perhaps sooner than anyone expects). In court today Crumbley said, “I am a really bad person.”
How is a really bad child able to get a gun? In Ethan’s case, by having really bad parents. According to Wikipedia, both have prior records (for DUI and check forgery), and often left him alone while hanging out in bars. They may have known he videotaped himself torturing animals, made Molotov cocktails, and talked about committing a school shooting. Instead of doing something about it, they bought him a handgun as a “Christmas present.” It’s evident that Ethan became a really bad child in part by having really bad parents.
I started writing this comment by thinking about adults who put guns in the hands of children. Since children can’t legally acquire guns, anytime a child has a gun, there’s an adult who did something wrong. The law should go after those adults every time, whether it’s intentional or careless, because children having guns is a really, really dangerous thing.
(I’m not talking here about supervised target shooting or hunting, although I think a good case can be made for treating guns like alcohol, i.e. you have to wait until you’re of age.)
Even if we can’t get more restrictions on guns, society should at least use tougher enforcement of the laws we have now to help bring America’s gun crisis under control. If you have a gun when you’re not supposed to, or use a gun to commit a crime, or carelessly allow someone else to get a gun, you should be locked up.
Yes, that includes Hunter Biden, provided he isn’t singled out and everyone else who commits a similar violation gets the same punishment.
By the way, Ethan Crumbley told us what his motive was. He wrote in his journal, “Hopefully my shooting will cause Biden to get impeached.” So this was an act of rightwing political terrorism.

While it may work as such an effort, it does not work as a matter of law. And that is why it will continue to haunt Republicans and the Supreme Court’s idealogically authoritarian majority until it is overturned.
Dobbs creates no binding reliable standard. It opens a floodgate of stupidity and superstition that was being held back by Roe for the last fifty years. It subjects all women to a mocking vaguery of incomprehensible state legislative gibberish incapable of reliable and consistent practical application.
Dobbs is premised on a myth cherished among self righteous conservatives that abortion can be tidily compartmentalized into “elective” procedures claimed to be common, casual, chaotic, and sought after by “bad girls” and which should therefore be banned, and “therapeutic” procedures claimed to be manageable, discrete, exceedingly rare sought after by “sad girls” which should therefore be allowed but carefully regulated and overseen by lawmakers. This premise has always been at the core of modern anti-abortion legal scheming. And while there are certainly those strident extremists in the movement who have held out for a no-holds-barred approach of sweeping prohibition without any exceptions, this premise has been vital to sustaining what little public support remains for the movement and for providing the legal cover to conceal the underlying cruelty, and barbarity towards more than half of all voters.
But the tidy distinction does not exist. And Dobbs will reside in the law to demonstrate that over and over again with increasingly repulsive consequences for as long as it takes to destroy the Republican Party in America, to which this impossible myth is now permanently wedded. Examples like Kate Cox in Texas will continue for as long as human life and Dobbs continue.
