Habba should be disbarred for legal incompetence. But that unfortunately isn’t a thing. I’m actually surprised that Middlebrooks hasn’t assigned her remedial education coursework. But it may be that he’d rather she returned to her day job reviewing home purchase sales contracts and notarizing.
In her initial response to the application her objections to the sanctions were based on a preliminary, unsigned draft of the application. The final draft used different figures for calculating hours and fees. Middlebrooks caught the error and ordered her to revise her response with corrected objections using figures and calculations from the final signed application.
It isn’t clear from the order what Habba was doing and Middlebrooks seems to have given up trying to help her. But only some of her revised calculations were made referencing the final signed application. Worse however is that she made basic mistakes in her math. Middlebrooks highlights only a few of the basic math errors in his order. But then correctly concludes that her objections can’t be relied upon by the court and have to be set aside and not even taken into consideration.
The rest of Middlebrooks dismantling of Habba’s response is no less condemning of the quality of her work. But it can’t be over stressed that in responding to an application for fee sanctions the respondent’s objections are the most important. They have to be based on reliable facts that can be clearly demonstrated to the court. And yeah. The math has to be perfect. Which isn’t too much of a strech. It’s addition and multiplication.
But it should be pointed out that the rest of her response is pretty much hot garbage as well. In deciding such an application the court must also consider not just the hours billed and the math used to add those up, but also the reasonableness of the rates charged. And while Habba makes a point of challenging the reasonableness of the total sums calculated in the application (over $1 million), as well as challenging each and every line-by-line billed amount for both fees and costs. But Habba never even once challenges the rates billed. Not even once.
It’s very clear that Habba does not understand the important legal distinction between the court’s process considering the claim for defense costs and the reasonableness of those costs. Grossly over simplified, objections are to the line items themselves and whether such costs are directly related (parking fees at the courthouse during trial are okay, parking at Heat games during trial are not). And reasonableness is to the rates applied in those line items ($500/page for photocopying is not gonna make it).
Free (and probably insane) lawyer not so free. And Republican donors get to pay and pay.

Which tells us all everything there is to know about the Roberts Court. It’s a fucking joke. It has no legitimacy. And he should admit that his own incompetent and fundamentally dishonest leadership has brought the court to this point.
Under Roberts’ leadership this court has made itself a willing instrument of a political party and offered itself up for sale to wealthy, connected influence peddlers aligned with that political party. Nothing like this has ever happened before in the entire history of the court. It’s really disgusting. And it all comes down to Roberts for failing to act in any kind of timely or decisive manner when he still could.

Gotta add, tracking document handling is a basic function in any law office in America these days and has been for a while. Documents are what law offices are about, FFS.
That it takes this kind of humiliating and degrading exercise for the Roberts Court to wake the fuck up and take the very first baby steps to implement some basic document control is frankly gob smacking to me. And if a tech struggle to implement document security and the steady loss of all their clerks slows the court’s work down for the foreseeable future, that’s a good thing.
It will require decades for the SCOTUS to recover from Roberts, if that’s even possible. The law itself will heal. But that court might not.

Because there is a very good reason why Alina Habba is the “Managing Partner” of a two attorney partnership with only a single associate, none of whom have more than a few years of experience in practice and who operate out of a strip mall. Her “partner” in the firm was passed over and moved along from three other firms never lasting more than a couple of years before washing up with her across the highway from a nail salon.
I’m guessing her partnership agreement is limited with respect to judicial sanctions. But even still, she’s a sinking ship. And I would not be surprised to see her one “partner” and her one “associate” bail to Rocket Lawyer* in the next month or two. Incompetent lawyers don’t get disbarred. But they do tend to have colorful employment histories.

Leaks aside, until Roberts the court has never aligned itself with a particular political party, going so far as to openly associate with, carouse with, and even coordinate with wealthy, influential, and well connected associates of that political party. Historically people have always complained about the political leanings of one court or another. But never before has a majority of the court so openly engaged with the leadership and the influential membership of a party with such regularity or such purpose. Thomas, Alito, Gorsuch, are openly and crookedly in bed with Republican, conservative PACs and consultants. We still don’t know who paid off AJ GangBang’s gambling debts. And ACB is just getting started. Five members who aren’t just taking the dirty money and gifts but who are coordinating their cases and decisions with Republican aligned private groups.
Having failed to intervene in a timely fashion Roberts is entirely to blame. The Justices use of lavish travel perks, and other benefits when traveling and speaking at universities and law schools has been extensively documented in the past. And though the court claims the justices voluntarily follow the federal judicial code of ethics in all such matters, discrepancies, oversights, and omissions have become common place under Roberts.
But now we have private PACs and fundraising groups aligned with the GOP and GOP lawmakers not merely socializing with a select group of justices but coordinating policy with them. Because Roberts made it so.
It’s a corrupt court. There’s little point in denying it now.
And so it’s up to lawmakers to take the steps necessary to restrict and limit the court’s influence until such time as it can be cleaned up, if that time ever comes.
