Chelan Judge has republican ties
The lawsuit will be heard by Judge T.W. Small, one of three Chelan County judges.
Small was appointed by former Democratic Gov. Booth Gardner. His wife is a Republican and a donor to the Republican National Committee, according to a letter he sent attorneys in the case outlining any potential conflicts of interest.
Small said he also has been discussing a potential federal appointment “with both partisan and nonpartisan individuals,” but could not reveal details.

Just to keep the record straight for everyone about re-votes, I thought I’d show this AP story that just crossed the wires about the NC situation. Remember, all those right-wing GOP sillies were citing North Carolina as the example of a state doing a do-over. Well, here’s the latest from that venue:
“RALEIGH, N.C. Jan 12, 2005 — A judge Wednesday threw out plans for a new statewide election for agriculture commissioner, the latest maddening turn in a dispute that has dragged on for more than two months.
Judge James Spencer told the State Board of Elections, which last month ordered the new vote, to find another solution to resolve the election.
Republican Steve Troxler leads Democratic incumbent Britt Cobb by 2,287 votes out of more than 3 million cast, but 4,438 ballots were lost in one county due to an error by a voting machine.”
I suspect we’ll wait a long time from the unsound politics characters before they comment on this one.

The Democrats have the automatic right to disqualify Judge Small. Something called an affidavit of prejudice. Each party to a case has the automatic right to make such a challenge. Since Vance is suing 39 county auditors (about half of them Democrats), Sam Reed, Frank Chopp and Brad Owen, and since the Democrat party is intervening, they could exercise quite a few of those challenges and end up with a visiting judge being called in from some place far away from Chelan County.
However, once the judge hears a motion in a case, the right to make the automatic disqualification ends. I haven’t read anything about anyone filing to disqualify Judge Small. If the Dem party wanted to intervene, they would have to include the disqualification request in their motion.
So I think that all parties concerned have agreed that Judge Small would be fair, or at least they have tacitly accepted him. So unless someone files a timely motion to disqualify Judge Small, let’s not knock the gentleman for alleged bias.
Judge Small instead should be commended for disclosing his wife’s political activities, and the possibility he might be appointed to a federal position. He had no obligation to make such disclosures, but exercised good judgment in doing so. This gave all sides an intelligent opportunity to exercise their right of automatic challenge.
Let’s hope that Judge Small makes a well-reasonable and clearly explained decision on this case, whatever it might be. A fair process and an honest explanation will go a long way to make the losing side and their supporters accept the outcome.

How about the next two paragraphs from that same AP story:

It was statistically impossible for the lost votes to change the election result, since Carteret County (where the 4,438 ballots were lost) was carried by Troxler by a 60-40 margin over Cobb. And by getting 1,352 of the identified lost ballot voters to say they voted for Troxler, that made absolutely no factual possibility that the remaining 3,086 lost ballots could have swung it for Cobb.
So North Carolina is a good example. By getting affidavits from a sufficient number of known legal voters whose ballots were erased — voters who would have no reason to say anything other than the truth, comibined with the 60-40 statistics, Troxler proved that the error could not have affected the outcome of the election.
Washington has a quite different situation. 348 improperly voted provisional ballots, plus another 1800 ballots that were not cast by identifiable voters in King County. There is absolutely no way to prove that Gregoire would have still won without these 2,100 improper ballots. And, even using basic statistics, Gregoire carried King County by 17 points, and would have gaimed 357 or so votes from these improper ballots, even if distributed just like the rest of the King County vote.

The vote counting and the affadavits had nothing whatsoever to do with the judge’s decision. Here’s the rationale that the judge used:
“Spencer also ruled the elections board broke the law by calling for the statewide election with only three “yes” votes from the five-member board. Spencer said the law is clear that four votes are needed to call a new election. The three “yes” votes were made by the Democrats on the board.
The board called a statewide election after another judge overturned its plan for a revote in just the county where the ballots were lost.
“What occurred here was an attempt at an impermissible end-run around a statute that is clear and controlling,” Spencer wrote. “The result was unlawful and will not be permitted to stand.”

Of course, there are still the Federal issues to contend with next.
And I’m sure the Federal Judge will also be a fair arbiter and come to a well-reasoned decision.
If both Courts rule for Gregoire, then she is our Governor.

I don’t think he’s bad at all from I read. However, if the Ds can get another county, I think it would be preferable.
To some extent it doesn’t matter as the Washington State Supreme Court will make the ultimate decision in the case. However, the trial court judge is important as he or she will determine the “facts” in the case and control what evidence is considered and what is not.
Does anyone know where the litigation documents are posted for the case?

That is a little weird. I believe Franklin County is a defendant in the action as Rossi has sued nearly every county and every county auditor. Maybe the judge represented Franklin County at one time or worked for them.
Democrats argue that while the election had some flaws, it was accurate and should not be nullified.
“Based solely on alleged miscellaneous errors Petitioners (the Republicans) ask this court to simply set aside the most expensive election in Washington state history and order that it be done again,” the Democrats’ motion to intervene said. “This election contest is unfounded in fact and law.”
Of course, the democrats were allowed to intervene.
The Jan. 20 hearing will deal mostly with scheduling, not the underlying issues. Republicans are pressing for a quick discovery process, while Democrats say they believe discovery won’t be necessary if the court gets to the underlying constitutional issues first.
Why shouldn’t there be any discovery? Perhaps if the democrats are arguing that the legislature not the courts should handle the contest. This must by why the court is holding off even setting a discovery schedule until after the case is briefed. One doesn’t need 2 weeks to set a discovery schedule.
I am guessing that the democrats are going to try to have the entire contest thrown out on the 20th. If it doesn’t work, discovery will go forward. If the democrats lose on the 20th, they may ask the Supreme Court to knock the case out before even having to have the discovery occur.

Of course the Democrats are looking to drag this out- bills in the Legislature are being set to be fast-tracked so that they can be signed by Governor Gregoire BEFORE any adverse court ruling. The longer the trial process is drawn out, the more time trhey are guaranteed full control- of course, that is more time for the D’s to wrap the noose around their neck and prepare for their usual two years and out of control. Democrats have not been able to hold full control of the governorship and the legislature for more than two years since 1957-62….
