Was there any accountability attached to the stimulus money showered on LE agencies? Has Obama ever expressed reservations about the militarization of police? The head of the Fraternal Order of Police said he was ‘taken aback’ by Obama’s handling of the controversy, since Obama previously “had been pretty good to law enforcement.”
Obama, it seems to me, scores a double whammy here. He excuses the unreasonable actions of his friend, then turns around and excuses the unreasonable reaction of the cop. What good does that do?

I’ve been saying this for some time (though not as eloquently nore artfully as digby, whose writing I admire). Tasers are dangerous and dangerously overused. Their original intent was to provide a non-lethal option for officers to use when they determined that there was an immminent threat that a citizen would harm him/herself or others.
But now they is used for compliance, and for punishment, for as little as an officer’s opinion that you are being either recalcitrant or not sufficiently respectful, and no penalties for use are ever imposed. An officer causing this kind of pain and potential damage by means other than the Taser would be brought up on charges. But for some reason (perhaps because it “leaves no marks” when shoved against an anus and triggered) we as a society have decided to turn our heads and ignore this use of excessive force.
We need clear and explicit policies discouraging these excesses, these policies should be public, and there should be clear, consistent, and sufficiently punitive enforcement for violations of the policy by officers.

Definitely not. My biggest criticism of the stimulus package was a re-increase of funds for the drug task forces that were slowly being eliminated under Bush. Some of these agencies have done a lot of damage because there’s no real accountability and the small town justice systems that these forces operate in simply don’t question what they do. That’s how things like Tulia and Hearne have happened.

The cop did not witness the two black males braking into the house. When he shows up, sees a door “jimmied” and only sees one black person, what might he think. That the other burglar is still in the house, calling gates out of the house would prevent the cop being ambushed. If he thought gates might be the legal resident, the two burglars could still be in the house and could be a threat to gates or his family.
Do you doubt that if gate walked outside and presented his drivers license that the incident would have ended in a few short minutes.

Officer Crowley is, to all accounts, a good cop. He is also a lower middle class guy working for the man in one of the most expensive neighborhoods in the USA. Leaving Gates albedo aside, he is a very wealthy andpowerful guy. He certainly would not be the first big shot to be pissed at not getting special treatment. For that matter, he just got off of a 10 hour flight. What did he drink on that flight? I usually have some wine esp if like Gates I am flying in thefront cabin.
Leaving skin color aside, Professor Gates is an extra ordinary and very rational guy. It would be a great treat to know him . He stands in the first class of our society. Still, as a black man, I would be very surprised if the Prof has not been offered tips to carry some white dude’s bags (as friends of mine have happen in front of me). It is entirely possible that Officer Cowley doesnot watch PBS and did not recognize Dr. Gates.
So maybe the issue is class and race? Upper class people DO treat cops badly. White folks do presume they are “better” than black folks. Either way, I suspect neither man needs to be talked down to by anyone. Officer Crowley, for one, certainly deserved a lot more respect from Mr.Obama.

I think both parties overreacted. Professor Gates was in the right to believe that once he proved who he was and that it was his house, the officer should have been more easy-going. Why did the officer want him outside? So the neighbors could see him? But Gates was probably exhausted from the long flight, took exception to the officer’s queries and went off. It probably wasn’t the mature or smart thing to do but it wasn’t illegal. And again, the officer took him outside where the scene got created.
But lastly, I know the black officer with Officer Crowley backs him up but what does Gates’ driver say about the whole thing? I haven’t heard about that side of it.

When an officer asks me for ID I ask “what did I do”? As he answers I am reaching for my ID. If the officer decides to do a little fishing concerning my car, where I am going, where I have been…I request a supervisor. If the officer requests to search my car (has happened once in rural Louisiana) I refuse. It is called a warrant and they need one. Makes them mad and accusatory, but that is not my problem.
We all have rights. We should choose to use them and not give them up because some knucklehead with a badge and a gun asks us too.

The facts are a man was arrested for being mouthy on HIS OWN PROPERTY and demanding an explanation from a police officer who was not inclined to “submit” his “authority” to a citizen. In an effort to “show this man who is in charge” the officer made a bogus arrest that was bounced. Gates was probably lucky he was so well known. The officer just had the dumb luck to pick on someone capable of fighting back on terms greater than his own.

As for what I “believe” I believe that Henry Louis Gates was mightily pissed off because aftger a long, long flight from Asia and having to break into his own house he was being treated as a perp in his residence by a cop. I believe that Gates is one of the foremost students and teachers of black-white relations and civil rights in this country, and I believe that he knows as well or better than anyone about the words and behaviors that constitute prejudicial treatment by civil authority.
I believe that being mightily pissed off and that telling the cop about it, at great and articulate length and with a great deal of bitterness and rancor, is Gates’ absolute civil right and freedom of speech as a citizen and I believe that it is also well within his legal rights.

I’ve been saying this for some time (though not as eloquently nore artfully as digby, whose writing I admire). Tasers are dangerous and dangerously overused. Their original intent was to provide a non-lethal option for officers to use when they determined that there was an immminent threat that a citizen would harm him/herself or others.
But now they is used for compliance, and for punishment, for as little as an officer’s opinion that you are being either recalcitrant or not sufficiently respectful, and no penalties for use are ever imposed. An officer causing this kind of pain and potential damage by means other than the Taser would be brought up on charges. But for some reason (perhaps because it “leaves no marks” when shoved against an anus and triggered) we as a society have decided to turn our heads and ignore this use of excessive force.
We need clear and explicit policies discouraging these excesses, these policies should be public, and there should be clear, consistent, and sufficiently punitive enforcement for violations of the policy by officers.

Definitely not. My biggest criticism of the stimulus package was a re-increase of funds for the drug task forces that were slowly being eliminated under Bush. Officer Crowley is, to all accounts, a good cop. He is also a lower middle class guy working for the man in one of the most expensive neighborhoods in the USA. Leaving Gates albedo aside, he is a very wealthy andpowerful guy. He certainly would not be the first big shot to be pissed at not getting special treatment. For that matter, he just got off of a 10 hour flight. What did he drink on that flight? I usually have some wine esp if like Gates I am flying in thefront cabin.
Leaving skin color aside, Professor Gates is an extra ordinary and very rational guy. It would be a great treat to know him . He stands in the first class of our society. How on earth does a story about some black professor being arrested, then released after a few hours, trump a local story of a black man raping, then stabbing to death a white woman?

I think both parties overreacted. Professor Gates was in the right to believe that once he proved who he was and that it was his house, the officer should have been more easy-going. Why did the officer want him outside? So the neighbors could see him? But Gates was probably exhausted from the long flight, took exception to the officer’s queries and went off. It probably wasn’t the mature or smart thing to do but it wasn’t illegal. And again, the officer took him outside where the scene got created.
But lastly, I know the black officer with Officer Crowley backs him up but what does Gates’ driver say about the whole thing? I haven’t heard about that side of it.

AT THAT POINT he was within his right to ORDER THE POLICEMAN TO LEAVE. His probable cause to be in the house EXPIRED the moment Gates PROVED his right to be there. Not five minutes later, not thirty seconds later, but, right fucking now.
Absent a warrant, absent a threat to officer safety, absent a threat of self harm my Mr. Gates the officer was, BY LAW, compelled to leave. He was not feeling threatened since he asked Gate to FOLLOW HIM OUTSIDE. You do not allow a threat to get behind you when you are concerned about an attack or harm. He wanted him outside to be able to say he was “disturbing the peace”. Gates should have merely closed the door once the officer passed the threshold. (Although Teresa made the observation that perhaps it could be argued that the attached porch is also the home).

When an officer asks me for ID I ask “what did I do”? As he answers I am reaching for my ID. If the officer decides to do a little fishing concerning my car, where I am going, where I have been…I request a supervisor. If the officer requests to search my car (has happened once in rural Louisiana) I refuse. It is called a warrant and they need one. Makes them mad and accusatory, but that is not my problem.

Since the officer was responding to a call of two black men and he only saw one, he might have believed the other burglar is still in the house, calling gates out of the house would prevent the cop being ambushed. If he believed gates might be the legal resident, the two burglars could still be in the house and could be a threat to gates or his family. Calling him outside was for the safety of both the cop and gates.

The facts are a man was arrested for being mouthy on HIS OWN PROPERTY and demanding an explanation from a police officer who was not inclined to “submit” his “authority” to a citizen. In an effort to “show this man who is in charge” the officer made a bogus arrest that was bounced. Gates was probably lucky he was so well known. The officer just had the dumb luck to pick on someone capable of fighting back on terms greater than his own.
They were both wrong. The cop used his “authority” to tilt the field to his favor and that is the issue here. The issue is not Gates mouth. Being an asshole is not illegal. Asking someone if they are racist is not illegal. Telling someone they are racist is not illegal.

The cop exceeded his authority, broke the law, and put his taxpayers on the hook for a hefty settlement. As for what I “believe” I believe that Henry Louis Gates was mightily pissed off because aftger a long, long flight from Asia and having to break into his own house he was being treated as a perp in his residence by a cop. I believe that Gates is one of the foremost students and teachers of black-white relations and civil rights in this country, and I believe that he knows as well or better than anyone about the words and behaviors that constitute prejudicial treatment by civil authority.
I believe that being mightily pissed off and that telling the cop about it, at great and articulate length and with a great deal of bitterness and rancor, is Gates’ absolute civil right and freedom of speech as a citizen and I believe that it is also well within his legal rights.
I also believe that the cop brought him out of the house at the end because he had to have Gates in a public place in order to justify the charge of disorderly conduct.
And I believe that the police report and Gate’s account are each incomplete and self-serving.
