With the late, delayed surrender of discovery from FOX, Dominion has filed today their motion for summary judgement.
For context, the binding precedent at issue, that establishes the standards for analysis to be used by federal judges and instructions to juries, was developed in a civil rights era suit against the NYT. The new, heightened standard was intended to be very difficult to meet. Mere negligence was rejected.
To prevail a plaintiff must demonstrate that the defendant’s statements were false. Of course. But in addition they must demonstrate that the defendants displayed reckless disregard for the falsity of their statements. That’s a very hard bar to get over. Any hint of plausibility, however absurd, can be enough to protect the defendant.
In their 180 page motion brief Dominion presents hundreds of statements of FOX News producers, personalities, and executives demonstrating their belief that the statements they were presenting in their programming about Dominion software were entirely false, could not be true, and were impossible. The communications presented in the brief would strongly suggest that FOX knew the statements they were presenting to their audience about Dominion software were false, and that it was their intention to do so for reasons that disregarded the harms to Dominion that the false statements would cause – malice.
The brief describes in detail, and provides supporting documentation from the discovery provided by FOX, that the motivation for FOX’s malice toward Dominion was the loss of audience (and revenues) triggered when FOX’s election night Decision Desk called the election in Arizona for Joe Biden. Executives and producers at FOX described how the presenting the falsehoods about Dominion to their viewers would help them retain the loyalty of those viewers and stem the loss of viewership to competing news services. To do this FOX persisted in presenting the false statements about Dominion software for months, even as government agencies, reliable third parties, reputable software scientists, some of their own guests, and their own staff presented FOX with mounting proof that the statements they persisted in making about Dominion software were false.
Throughout this time, as FOX was knowingly presenting false and damaging statements about Dominion software to its audiences, Dominion was in constant communication with FOX, explaining the falsity of the statements and the damage the false statements was doing to the company. Over 3600 communications were directed to FOX from Dominion about that.
In addition to asking the judge to award summary judgment in favor of the plaintiff, the motion alternatively asks the judge to find partial summary judgment consisting of a finding that the specific defamatory statements that are alleged in the complaint are proven false and that there is no presentation available to the defense to refute that finding.
I don’t think I’ve ever seen a defamation complaint so stacked against the defendant. Most of FOX’s replies to the complaint so far have consisted of arguments that the damages sought in the complaint are excessive. Their reply to this motion would likely be the first exposition of how they would really seek to defend against the actual complaint of defamation at trial. My guess is they will focus on these internal communications they have withheld from discovery until only recently. And that this focus will be to portray the statements admitting malice and reckless disregard as “vigorous debate” among “diverse colleagues” etc. That might take advantage of some of the course language employed. But at the end of the day, reluctance to maliciously and intentionally defame someone is not a defense. Clearly many of the producers, personalities, and executives at FOX harbored concerns, even grave concerns, about how the lies they were intentionally spreading might harm themselves. That is a recurrent theme in the internal communications. It’s very notable that literally none of those communications express any concerns, grave or otherwise, for the harm the lies might do to the plaintiffs.

They can rule on the law, and the legal analysis applied by the lower courts. But they cannot rule on factual findings. If a jury finds that FOX made false statements about Dominion, that FOX did so while recklessly disregarding their own knowledge of the falsity of those statements, and demonstrated a malicious intent in that disregard, those findings stand.
To reverse The Court would have to sweep aside Sullivan completely and declare a new, even more impossibly strict standard for defamation plaintiffs. But any such new standard would necessarily run contrary to the interests of most conservative, wealthy fascist assholes, and most corporate villains, who rely on vexatious threat lawsuits to control what the media dares to report about them (don’t you dare report that Peter Thiel is gay).
