For the administration to prevail, the Ninth will have to:
-reverse the court in Flores, since the new rule is inconsistent with the agreement the government stipulated to in that case;
-reverse precedent from no fewer than four other recent previous rulings, including Flores, that enacting new rules for the purpose of deterrence is a violation of the Fifth Amendment;
-find that a proposed rule which, by DHS own admission, would incur additional costs to the agency by as much as $1.3 billion per year, would not require OMB review for all changes in excess of $100 million as required under the Administrative Procedures Act.
Those are essentially the three major fact finding stumbling blocks the administration must overcome. Of course, piled on to all that will be briefs and discovery from the 19 plaintiff parties investigating the origins and intent of the new rule as well as hundreds of amicus briefs arguing damages extending beyond the contours of Flores itself.
Gee is very likely to order a stay of the rule. Which can then be brought before the Ninth in this case. Unless the government can muster sufficient argument to overcome these factual deficiencies before the rule would go into effect, it seems also very likely that the Ninth would uphold the stay.

Low approval/high disapproval is most likely to translate into an incumbent loss when public sentiment is strongly in favor of “change”. The implication is that “change” voters are more motivated and come out in larger numbers when the incumbent performance is perceived to be failing.
The challenge for Democrats is to promote that perception of “failure” while denying the incumbent any opportunities to “succeed”. And with this incumbent that is complicated. He personalizes everything. He is a master of personal politics and bullying tactics. He flatly disavows all of his own numerous personal failures, typically declaring them instead to be enormous successes. And more than one major news network assists him in all this.
So far one challenger strategy that is emerging is to promote the perception of a “system” or a “status quo” that is failing. That way, in order for the incumbent to personalize the attack he must first associate himself personally with the “system” or “status quo” being accused of failure. That goes against his “outsider” personae and diminishes him in the eyes of his key supporters. Moreover, most of the time when he falls into that rhetorical trap he responds by blaming his own team or party, which further diminishes him.
Democrats might do better to focus our criticisms less on the incumbent personally, and more on his amazingly incompetent administration, his amazingly incompetent party, the failing policies they promote, and the failing system that results. The piles of dead toddlers are less the result of malice than they are the result of soaring incompetence. Pretending that “I meant to do that” is just part of the gaslighting. The only part of this administration and its party that is intentional is the grift and corruption.

The prosecutor’s probable cause affidavit includes the victim giving what are now known to be multiple false statements to police in order to prompt the arrest. The accused neglected to get the advice of counsel before waiving their probable cause hearing. So now they have to go through pre-trial and hope the county prosecutor figures out that he’s been had. My best guess is this will result in a plea agreement that is very, very favorable to the def. Misdemeanor disorderly conduct or the like.

That is not objective journalism. But it is often more entertaining. And it certainly is FOX.

And they deliberately exclude objective evidence from their reporting when that evidence would contradict the messaging that they are promoting. They are not completely alone in doing this.
