Dear Rep. Reichert,
I understand that you have submitted three candidates to the White House as a replacement for John McKay as U.S. attorney for Western Washington, and while I understand that at least two of the candidates have adequate legal credentials, I fear that in conducting your search you may have overlooked the most important qualification: loyalty.
It wasn’t McKay’s legal expertise or prosecutorial skills or even his investigative shortcomings that cost him his job (hell, it’s not like it took him 18 years to catch a serial killer who was a prime suspect from day one,) it was his lack of loyalty that got him fired. What President Bush and your fellow Republicans need most in this office is not a top-notch legal mind, but a faithful and loyal companion.
And who could be more faithful and loyal than Major, who is not only looking for a new home, but could use a high-paying government job as well? Here is his CV:

Yeah, sure, Major might believe that he’s smarter than you, but then who doesn’t? And you yourself can attest to how being a “big friendly golden boy” can take you far in politics.
So please, add Major to your list of candidates for U.S. attorney. Major desperately needs a new home, and Attorney General Gonzales desperately needs a loving, devoted companion, who enjoys making mischief. It’s a perfect match.

When in the above letter I quipped that “at least two” of the candidates were qualified, I was of course implying that Rick White was not. Well, HA regular Richard Pope has more on that in the comment thread, pointing out that White was suspended from practicing law in 2003, and is currently not eligible to practice law in Washington state.
But he is a loyal Republican, and really, that’s all that matters.

I am very disappointed that Dave Reichert didn’t put me on the list of three candidates to be appointed to the U.S. Attorney position. (Okay, I am being a little facetious, so please don’t throw the rotten tomatoes at me!)
To be honest, I didn’t apply for the position. And I don’t think I would be among the top three qualified people that could possibly be found among all the Republican lawyers admitted to the Bar in western Washington.
But at least I meet the legal qualifications for the position. I am admitted to the Washington State Bar and eligible to practice law in the State of Washington. I have never been disciplined or suspended from the practice of law.
That is a lot more than I can say about Richard Alan White, WSBA # 13683, who is one of the three candidates recommended by Dave Reichert and Norm Maleng to be U.S. Attorney. Rick White is current an “Inactive” member of the WSBA, which means that he is ineligible to practice law in the State of Washington, and therefore unable to perform the legal duties of U.S. Attorney for the Western District of Washington:

Prior to taking “Inactive” status, Rick White was actually SUSPENDED from the practice of law. Back on April 19, 2005, Goldy posted a thread about how Rick White might possibly become the GOP candidate against Maria Cantwell for the 2006 Senate race. I did some quick research (man, I was poster # 1 on that thread!) and discovered (from the WSBA website) that Rick White was currently SUSPENDED from the practice of law on that date, April 19, 2005:

To be SUSPENDED from the practice of law requires an order signed by the Washington Supreme Court. I am going to call the Clerk’s Office of the Washington Supreme Court and the records section of the Washington State Bar Association to see if I can get a copy of Rick White’s SUSPENSION order. If the WSBA membership database was correct about the SUSPENSION back on 04/19/2005, a PDF copy of Rick White’s SUSPENSION order would certainly be a nice thing to be able to link to on a blog website or newspaper website.

I have to agree with you concerning Rick White–he has no business being considered for the US Attorney position. He hasn’t practiced law in years, and even when he did, he practiced bankruptcy law. Such history hadly qualifies him for such a prestigious position. His only apparent qualification is that he’s a good and loyal Republican. Sad.

I just spoke with the Clerk’s Office of the Supreme Court of Washington. Richard Alan White, WSBA # 13683, was suspended from the practice of law by order of the Supreme Court of Washington on August 12, 2003. The case number in the Supreme Court of Washington is 2000312. When I search this case number on the Washington State Courts records website, the Event Description says “Disciplinary Action”:

I hope the above link works! This “Disciplinary Action” case apparently involved several attorneys, since there are different cases for orders reinstated many of these attorneys to the practice of law (or at least un-suspending them, as the case may be).
The Clerk’s Office also informs me that Mr. White’s suspension was terminated by Supreme Court order on August 15, 2006, after slightly over three years of being suspended. However, Mr. White was not readmitted to the practice of law (i.e. “Active” status), but rather placed on “Inactive” status, which means that he cannot practice law at the present time, but is eligible to apply to the Supreme Court to be reinstated to the practice of law in the future.

For reasons that I cannot fathom, rather than just shut off the bait car, the police waited until after the thief threatened the life of two motorcycle officers, requiring a third officer to fire at the bait car.

@5 Yes, it’s a presidential appointment and U.S. Attorneys serve at pleasure, but they also require Senate confirmation; and, in office, they’re supposed to discharge their duties impartially and according to the law.
This isn’t about the president’s prerogative to replace appointees. It’s about a systematic effort to misuse federal prosecutors to smear Democrats with false charges of election fraud, and to cover up Republican vote-fraud crimes.
Bush and Rove want loyalists in these positions so they’ll carry out orders to conduct witch hunts (see, e.g., 2004 Washington governor’s race) and keep their hands off Republican vote-suppression activities, even when they constitute federal crimes (see, e.g., the nationally coordinated RNC effort to challenge the voter registrations of black soldiers deployed to Iraq and Afghanistan).
The fact U.S. Attorneys are presidential appointments doesn’t give Bush a prerogative to use them to obstruct justice or commit crimes.

I’ll say this — you probably couldn’t find a better candidate than Jeff Sullivan for the job. The guy is a career prosecutor and actually spent time in the trenches as the elected in Yakima county for many years. He’s tried a lot of cases and is well respected around the state. While I’m sure he’s a Republican, and therefore I probably disagree with him on a lot of things politically, he’s exactly the type of qualified candidate that should get the job.
Which is exactly what’s so odd: given the way this administration operates, how the hell did he even get to be a candidate? Vaska seems to be a decent guy too, and White isn’t even that bad. What the heck is going on here?

Managing a staff of dozens of people and deciding whether to prosecute major federal crimes and representing the federal government in major civil litigation?
Hell, I ran for the state’s lowest court last fall and people crucified me over my alleged shortcomings. And I have never been disciplined by the state Bar Association or suspended from the practice of law by the state Supreme Court.

Richard — I should have been more clear. White should not be appointed as a US Attorney because of his shortcomings. But from what I’ve seen of him, he’s not a particularly bad guy. He’s a moderate of the type that the GOP doesn’t tolerate anymore. Politically, he’s not bad.
For this position, he’s completely the wrong guy. Sullivan strikes me as the ideal candidate. Vaska is good too, but #2 to Sullivan. White has no business getting this particular job.

By the way, Richard, it looks like it’s at least possible that Rick White got suspended for not paying his bar dues. Until you get more info from the WSBA, the link you provided seems to say that. When somebody goes to inactive status, it means they hang on to their license but don’t fulfill their annual CLE requirements and basically quit practicing law. It gives them the option of starting over again someday without having to retake the bar, which they would do if they resigned. Perhaps White decided he didn’t want to practice law anymore, and just didn’t go about it the right way. It seems possible that he just quit paying his bar dues, got suspended for it, then changed his status to inactive so he wouldn’t have to do CLEs or pay his dues.
This, of course, is merely a possible explanation. It certainly doesn’t make him qualified to be a US Attorney, because he’s not.

You are correct. But there is a big difference between going into inactive status, and being suspended by the Supreme Court for failure to comply with the requirements to be licensed as an attorney.
Going into inactive status means the attorney is basically saving some money by paying lower bar association dues. You don’t have to make up the dues savings during your inactive status, but you do have to make up the annual CLE requirements that you missed during the meantime.
Being suspended for failure or refusal to pay dues is a form of administrative sanction, negative public record, and shows a lack of personal responsibility on the part of the attorney. To get reinstated — even to inactive status — the attorney has to pay DOUBLE the amount of delinquent dues that were missed during the period of suspension. To become active, the attorney must make up the annual CLE requirements that were missed during the meantime.
By the way, I agree 100% with your analysis regarding Jeff Sullivan and Mike Vaska. Presumably, the committee really expects Sullivan to get the job, and they added the other two people to the list to make things look good. But why fill the list of also-rans out with Rick White? Just doesn’t make sense.

Following this decision, the BIAW’s Tom McCabe provided McKay’s office with what McCabe called “forged” absentee ballot signatures, which McKay forwarded to the FBI for investigation, and the FBI concluded the signatures were “not forgeries.”
Let’s also review the civil suit: After spending $2 million on the best corporate attorneys in Washington state, and with help from the RNC’s national election-expert lawyers, the GOP got a decision from their handpicked Republican judge in their handpicked Republican County that THEIR candidate received 4 fraudulent votes, Gregoire received 0 fraudulent votes.
